In business litigation, winning often means no one writes a check.
Our injury practice is measured in recoveries. Our commercial practice frequently is not — and if you run a small company, that distinction is the whole point.
A co-owner sues to force the sale of your property, and you win by keeping it. A supplier threatens a claim, and you win by having it dismissed. A former partner takes your accounts, and you win with an injunction. A manufacturer stops paying what your agreement entitles you to, and you win in arbitration. None of those outcomes appears in a settlement total. Every one of them is what the client was actually buying.
What we handle: breach of contract · breach of fiduciary duty · partnership, shareholder, and LLC disputes · real property and partition actions · revenue-share and licensing disputes · non-competes and trade secrets · commercial arbitration.
Some of what that has looked like. We have defeated a forced sale of a client's real property in a partition action and put sole ownership with clear title in his hands instead. We have brought contract and fiduciary-duty claims into arbitration against a manufacturer on behalf of the physician-inventor whose product it sold. We have represented small companies against counterparties many times their size, and we have gotten clients out of litigation on terms they could live with.
Many of our commercial resolutions are confidential, and we honor those agreements. What we can tell you is that we take these cases the same way we take a serious injury case — with the assumption that it may be tried.
