Trial & Motion Practice

Ryan Posey tries cases and litigates the motions that decide them — dispositive motions, discovery fights, and the post-trial motions that decide whether a verdict survives. Alongside the injury practice he handles commercial disputes for small businesses: contract and fiduciary-duty claims, partnership and shareholder fights, real property litigation, and arbitration. He is admitted to the Supreme Court of the United States, the United States Court of Appeals for the Fourth Circuit, and six federal district courts.

• Pedestrian struck in a crosswalkOur client was crossing with the signal when a driver turning out of a parking garage struck her, causing facial fractures, broken ribs, and dental injuries. After the driver's insurer tendered its limits, we identified an additional layer of commercial coverage — the driver had been running an errand for his employer — and pursued it.
• Passenger struck by a stolen car in a police chaseA stolen vehicle fleeing police at high speed collided with the van our client was riding in. We obtained a recovery for his injuries even though the at-fault driver could never have satisfied a judgment.
• Uninsured / underinsured motorist victoryWhen our client's own insurer refused to pay fair value after a serious collision, we litigated the UM/UIM claim against the insurer and won.
• Carbon monoxide poisoning at homeOur client was poisoned by carbon monoxide inside her own apartment. We brought a claim over the building conditions that allowed it to happen and resolved the case.
• Fall in an apartment-building elevatorWe represented a resident who fell in her building's elevator and suffered a knee injury requiring treatment, and resolved the claim.
• Injured motorcyclistWe represented a rider seriously hurt in a collision and resolved both the injury claim and the federal Medicare reimbursement interest that followed it.
• Motor-vehicle collisionWe handled an injury claim from crash through settlement, including negotiating the health plan's reimbursement demand so more of the recovery stayed with the client.
• Injury at an organized recreational eventOur client was seriously injured riding a drift trike at an organized event. We pursued claims arising from how the event was run and resolved the case.
• Recreational vehicle crashA claim arising from the crash of a three-wheeled recreational vehicle, litigated against the seller and resolved.
• Business contract disputeWe represented an individual in a breach-of-contract action and litigated the case to resolution.
